Update To My Bad Day

Well folks as you may remember my DD was damaged in a car accident and USAA wanted an estimate from an AD, after I do that they say it is not good enough. They want me to send it to thier "Rolex Specialists" I said that was not good enough, so they said I could take it to an AD with a Rolex tech on staff. Then they decided that was not good enough. They said I would have to send it to Rolex in New York. So I did. Well Rolex came back with a higher price of repair than the AD. Getting ready to fax it over to the crooks at USAA so I can await thier BS response.

Well, I've been a USAA customer for 29 years and insure all of my watches with them. I have never had a single problem with them on any auto or homeowners issue. Knock on wood, I've never had a watch claim, but don't find the "crooks" to be a realistic characterization, especially compared to other insurers. My friend had a Breitling go missing in his house. Thought someone must have stolen it. USAA paid instantly. I thought that pretty good.

I suspect a happy ending on this, let us know.

Well I hope the way I have been treated is not the norm, but when I get his by thier insured who is DRUNK and they dont even want to pay for all of my rental car!!! I call them crooks!

That's interesting. Thought you were their customer. I got hit by a cabbie a few years back and his "fly-by-night" insurer paid for my entire rental. Have to say I'm surprised they are hassling you on that.

Well, USAA is about 95% military and retired military. Someone's career may have just come to an end with that DWI.

The lady that hit me was in her 60s, didnt seem like the military type.

Same here, long-time customer. We had several watches stolen last year, and USAA paid within a week. Definitely the best large company I've ever dealt with.

You say it was THEIR insured who hit you? If that's the case, then they're doing exactly what they are supposed to, and making you work for your claim.

Hope you get resolution soon.

I would think they would want to treat their insured better than this by settling this case as quickly as possible. In most jurisdictions, a dui driver can get hit with punitive damages. Since punitives are not covered by insurance, the driver has to pay those out of pocket. The conundrum that an insurance carrier will find themselves is that, if they had the opportunity to settle within their policy limits and they did not, they could be liable for bad faith. Bad faith could subject the insurance carrier to punitive damages and attorneys fees.

An interesting phenomena occurs when insurance carriers drag their feet in the manner in which they handle property damage claims and that's the fact that people might not continue to ignore their pain. I have defended many a case where the original adjuster tried to save a few bucks on the prorperty damage or rental and the individual decided to go see a doctor and lo and behold they have a herniated disc.

The foregoing should not be construed to be legal advice nor the rendering of a legal opinion.

I appreciate the input. To be honest, I am really surprised that I am being treated this way given the fact that I am trying to get anything other than the basic loss reimbursed. I was finnally contacted by thier customer dispute department today. I dont know if they can go back and get the area office to do anything or not, but I want to do everything I can to try and settle this with them. I also think it would show good effort on my part should this go to court. Our conversation was almost comical when she asked about why the first week of rental was denied. I told her because I was told I drug my feet on filing the claim ect. I told the reason I couldnt file the claim right away was because I didnt have thier insured's information. She as why, and I told her, "BECAUSE SHE WAS TOO DRUNK TO GIVE IT TO ME AT THE SCENE OF THE ACCIDENT!!" I had to wait for the police report to even find out who hit me!!

hmmmcogent, specific 'observation', not of course, legal advice/opinion. nevertheless, well worth paying attention to, IMHO. And, yeah, we're on your side.
