Ed (RockRolex) is the man to ask about IP issues, but as far as I know, unless you're claiming that the car's a Rolex, there's no infringement since the limits of the plate's function are pretty obvious.

Yes, it is tacky, but more to the point, it's ostentatious in a manner that may or may not be funny, depending on how you look at it.

In answer to your question, John, the use of a Rolex plate on a car would probably not be considered trademark infringement. No one is going to confuse a car for a watch (even though some Rolexes cost more than some cars). And that's especially true for the portion of the public that would be buying Rolex watches. They are typically going to be sophisticated enough to know that Rolex doesn't sell cars. Also people are familiar with vanity plates and understand they are an expression of the owner of the car and not the word the plate represents.

Now it might be possible for Rolex to claim trademark dilution on the ground that the use of the Rolex name on license plates dilutes the value of the Rolex brand. That's a hard claim to pursue and Rolex is better off spending its legal budget on counterfeiters.
