There is no MSRP as the watch is no longer made. Also, how the AD chooses to insure items is their concern and has no bearing on any claim the OP has.

The company should have terms & conditions that the OP agreed to that would define their liability. Assuming that they haven't told the OP, in advance, what these terms are then it is a matter of coming to an equitable solution, and it sounds like that is what will happen.

All companies have issues like this. Bad things happen, but it is how they respond that counts, and we don't know that yet. Let's delay the legal rhetoric and naming and shaming of the AD for now!

I would have an issue with this if they didn't reach out to you asap when the watch/package was lost. You shouldn't have to inquire about the watch to find out that it's been lost. Your AD needs to do you right on their mistake.

I know a person who the AD lost his watch, about six months ago.
I think the watch was a pre ceramic GMT Pepsi. The owner of the watch got a new Submariner Green bezel.
Just be patient and polite, but at the same time let them know that the watch was VERY VERY important to you.
Believe my friend, this is a game you are going to win , is the reputation of the AD in play here.They probably didn't reach out to you soon because they looking for the watch.
What model was the watch they lose?

I think you are going from a discontinued model at the end of the range (albeit large at 39mm), to a in production (And for the forseeable future will be available) model. I don't think that's a fair trade.

The Daytona wears small - shoot for that.

As a minimum they must offer you Retail value for the watch.

If the market value is higher than MRSP then they should offer you this.

Instead of the cash, as a goodwill gesture they should probably offer to promote you to the top of the list for the next like-for-like (or near-as-dammit) model as a replacement.

If there is an in-demand curve you fancy, then no harm in asking to be put at the top of the list and offering to pay the difference.

First there are all reasonable, final option is a long-shot.

Good luck with getting it all resolved. I know another member here who's watch (a 36mm Pt DD) disappeared on the way to an independent watchmaker for service. I wonder if there aren't some internal thieves who recognize the addresses and what could be contained in the packages. Seems like a nasty racket to me.

Of all the ways this could have happened, be happy it did so at the expense of your AD. This will work out well for you I would suspect if you play your cards properly.
