AD asking $2000 over MSRP
Again in my travels I walked into an AD who had a SS Daytona (I don't want to say where). The MSRP on the Box was $9200 and he was asking $11200. I guess not all AD's sell at MSRP.

as far as i am aware it is illegal to do this. contact rolex.

Things might be different in the U.K. I posted here about a year ago when the SS Daytona was the hot ticket that my AD here in Canada had another for sale, for $2,000 over list. One of our members from New York State jumped at the chance to fly up, stay long enough to buy it, and fly home.

MSRP = Manufacturer Suggested Retail Price.
So I guess it is just a suggested price. I called NYC Rolex before and mentioned this, and I was told, they can sell whatever price they want, they don't stop them from doing so. MSRP is the same for car dealers too, they can sell whatever price they want. |

Thats why they are invariably called "recommended" retail prices or "suggested" retail prices or "manufacturers" suggested/recommended retail prices.

There is a long-standing Federal law in the U.S. that prohibits any manufacturer from requiring an independent dealer to sell the goods they purchase at a specific price point. To do so would inhibit free competition. Of course, all manufacturers recommend that a retailer not devalue the product by selling below their guidlines. Most businesses abide by these suggestions or face non-renewal of their sales agreement for any number of infractions and the product being no longer available to them. |

I was referring to the Robinson-Patman Act of 1936 which prohibits producers from selling the same goods to equally-situated distributors at prices that might be considered to reduce competition. A good example would be chain store pricing vs. independent dealers. Therefore, my comment on the subject for which this thread was originally created was not wholly appropriate. Thanks for allowing me to clarify this issue. |

I had my AD offer to put me at the top of their Milgauss GV list...for a $2,000 deposit and the watch was going to be $10,000. The MSRP on that is $6575. I told the sales girl to go scratch. |

Er, in Australia there is a "Trade Practices Act" where the manufacturer can tell the reseller to sell at a "Maximum retail price" and this is the max a retailer/reseller can sell the goods for. It's illegal in Australia to put a minimum price.
I suppose every country has different consumer laws so caveat emptor! |

It may not be illegal, BUT in the US if the Area Sales Manager finds out that dealer will NOT BE GETTING ANY MORE ALLOCATED MODELS.
I would make a call to Rolex. |

Yes an AD can sell a Rolex for any price they wish. I have been through this argument with Rolex about a year ago. In short Rolex in New York, Bev. Hills, and Dallas advise that the msrp is just that a suggested retail price. I find Rolex to be two faced the AD can charge more but a discount is discouraged. This double standard is another reason why at times I find Rolex is a large turn off.
