With 5 laps to go LH was 5 seconds ahead and MV was losing time.

Wrong! It was even worse: 5 laps remaining and when the accident happened HAM was 11.962 s ahead of VER.







And at that moment (screen shot below but difficult to see) VER was about one wheel length ahead of HAM, not allowed and should have been penalized.
