Joint Custody
Is it possible to lose joint custody for the child? What are possible scenarios? If any.

If one of the parents did something bad, I am sure joint custody could be revoked and sole custody given to the other parent. There are too many scenarios to name that may cause this.

Do verbal agreements hold up in court? Also past phone bills/gas bills accured while living together?

I would ask an attorney who focuses in family law.

Joint custody should be filed for in family court. It's a relatively simple proceeding provided the parties involved are amicable. Even if they are not most judges will grant it and once granted it takes an unusualy strong set of circumstances for a judge to revoke it. If you haven't done so already, I wouldn't put it off too long though. You can file for joint custody on your own with minimal paperwork and no attorney, (unless you foresee a custody battle). Wish you the best, Joseph

depends on what state you are in.
verbal agrees dont mean squat, but if you can agree to reduce them to writing, courts are *generally happy to encourage parties to agree. Just remember when asked by Judge to start your sentences with "I feel (we) that it is in the best interests of the child that..." easy way to remember? BITCH (Best Interest of The CHild) In TX at least, Joint Managing Custody is presumed (JMC). Easiest way to lose the presumption? Reach out and touch someone... fam violence (on anyone in the home, not just fam member or relative) destroys presumption of JMC. other way is to get convicted of felony (aka a serious crime). btw do you mean conservatorship or custody? They are different, somewhat interchangable terms in many states, but they often mean different things. If all you want to do is get child support dropped, that is one kettle of fish. if you want 50/50 time with the child, that is something else. Both can be agreed upon, but it depends on what you are wanting. Regards, -Lavaman, -ESQ. |
