After the mail to cancel my future purchase, the seller doesn't want to refund me the deposit I sent him by bank transfer last saturday to reserve this 5512... What do you think?

He just told me to send him 10% of price for deposit to reserve it a few days, time for me to get funds and transfer the remaining amount...
there are their conditions of withdraw : " Right of withdrawal (Ref. Art. D.Lgs no.185 of 22/05/99, applying the directive 97/7/ce, relating to protection of consumer rights concerning distance contracts). Purchases concluded at www.XXX.com are regulated by legal decree 185 of 22nd May 1999. The buyer can withdraw from the contract by written communication via registered post to XXX, XXX, (Italy), within 10 working days of receiving the merchandise. Communication can also be sent by telegram or fax to: (XXX) on condition that we receive written confirmation by signed registered post, with return receipt, within 48 hours after said communication. The client must arrange, at his/her own expense, the return of the merchandise, utilizing the original packaging, within 10 days of receipt of said merchandise. The merchandise will be examined and if found intact and void of any damage (unused), the buyer will be refunded as requested (bank transfer, postal order, etc) or substituted with other products of the client's choice. In any case the reimbursement will be made in the shortest time possible, no more than 30 working days from the notification of withdrawal, obviously subject to the return of the merchandise. For no reason must the returned merchandise be sent by Pay on Delivery: In this case it would be immediately sent back. In any case we strongly advise the client to contact us at the address info@XXX.com or by phone at XXX to facilitate the procedure." |

"Conditions of buying new products: All new watches are available upon request if not present in our storage facilities. The delivery will be agreed at the time of ordering with a maximum wait of 30 days. The payment for new watches must be made immediatley and completely. Only in the case of collection from the shop could a deposit of 30% be allowed with the balance payable upon collection and however we reserve the right to accept this method of payment or not. In the case that XXX is not able to deliver the item within the agreed time the entire payment will be returned to the client. Images of the new watches published on our website are purely indicative. In the absence of specific information relating to the order there cannot be complaints if the order is not exactly as requested. It will not be possible to exercise the right of withdrawal from the purchase of new watches as they have been specifically ordered. XXX is a private company and is in no way affiliated to the brands of watches that it sells." |

Horrible, crooked seller, if he doesn't refund your deposit, especially considering that the watch was advertised as all original, which it's clearly not.

Really? Did he have the word "parts" in there? Even so, if I were the buyer I'd still argue that the watch doesn't have all original "parts." It's semantics at that point, but the luminous is a "part" of the watch, and it's not original.
That issue aside, a seller who didn't disclose that the dial was refinished/relumed is a bad seller, of course. Unless he didn't know. And if that's the case, once it's discovered all bets are off and he should refund all money. Good luck! |

The dial is the issue here, most 40 to 50 year old vintage watches will have had service replacement bracelets, inserts and even new glass - that is fine and accepted if declared up front by the seller.
The dial is a completely different issue and a deal killer for most buyers - again unless any restoration work or even declaring a later replacement dial has been put in - some buyers may be prepared to pay - I wouldn't personally. It seems the dial in the watch is not the one the buyer thought he was placing a deposit against. Is it buyer beware or the seller being economical with the truth - not sure, but my gut feeling is that he should get his deposit back. The OP is man in a hurry, less than 24 hours later he was on to his next one. He needs to slow down and learn how to do his homework properly. |
