Based on your explanation of the listing, and their "like new" statement, I would say they misrepresented it.

As for the remedy, I would pause and take inventory of your options - starting with "How do you want this to resolve to your best outcome?"

Sending it back could incur some restocking/duty chargebacks/shipping costs that you are not aware of. Remember you're dealing with a company that already said this was "like new". SO comb their website to understand their policies and the fees involved with a return.

I presume you used a credit card. If so, the sales price was denominated into some currency other that British Pounds. Now the exchange rate could be different and to your detriment. Plus the CC company may be charging you fees per transaction - including the refund.

Lastly, keep a professional bearing in all written or verbal communication. I believe your best route is to ask for an "accommodation" for the bracelet condition being "worn". Ask for them to give you a credit equal to a local watchmaker's reasonable polishing charge.

This way you keep the good deal you wanted and get the "like new" piece you expected.

If they represented that watch as like new then I would be on the phone in a minute and demand either a full refund or a discount off the price you paid.

The shop shoe be ashamed that they described that watch like new. It is far from it.

Like others have said though, the marks on the bracelet will be put on there by you in a matter of a few months of you wearing it. I think the point here is that they misrepresented the condition of the watch.

Yeah no way "like new". I'd say those are normal, good condition scratches which you would accumulate anyway.

...perhaps, if you really like the model, and an actual mistake was made in sending you the 'other/wrong' watch, allow the seller to send you the correct one along with a post paid box to return the first one. That or a refund; you win either way...

On the flip side Mickey did raise a point with depends on how much you paid. If it was $2k or below then fine...

I paid 400 euro less than what I can get a brand new one for. but I thought, it's a 2012 watch in like new condition, I'll save 400 euro !!! Should've gone new.
The seller has now agreed to send FedEx to collect the watch & send me a refund, I paid by bank transfer so I'm sure I will have incurred some fees. As yet though the seller has not confirmed the value of the refund, I think shipping is around 60 euro each way so I don't know if he intends to deduct this from my refund.
He has told me that he made a mistake, he had 2 watches, but he had already sold the like new one. Due to this being 100% the sellers fault & 0% my fault I feel it would be unfair to expect me to pay the shipping, I'll keep you posted

Glad it seems to have worked out...but are you preparing to compound his error with a new one? I would not release the watch to FedEx until you have a documented agreement about the net refund and the means for that refund.

You have zero leverage if he has the watch and can unilaterally control the amount to be refunded. Just

At the moment I am struggling to get a commitment from the seller as to how much I will be refunded, I have a feeling it will be what I paid less about 120 euro for delivery & subsequent collection !!!
If this happens I will name & shame them (I'm not into bad mouthing anyone but fair is fair !!! )

For the record I wouldn't mind such scratches but I'll agree that at this point it was not described properly. It seems like it was a mistake by the owner which he, at least, recognized and stood up for so I can only look forward to the conclusion.

That is not "like new" and although you may accumulate those scratches yourself within a month or so, I certainly don't fault you for feeling like the condition was misrepresented. I would raise the issue.
