UCC Article 2 risk of loss rules should provide guidance on who takes the loss should the goods not make it to their intended recipient. Seller chose the method of shipping and in most cases takes the risk should goods be lost or damaged in transit before the buyer receives them. The question is a matter of proof. Lots of pontificating without any understanding of the legal rules underlying commercial transactions.

I will never use UPS stores for high value shipments...
I know there are good one's & bad one's but I made up my mind yrs ago only to drop off at Fedex hub's even if it's a great inconvenience. It seems like a recurring theme that things go missing while in the possession of UPS stores.
I know the Fedex stores have had there issues as well. In my experience Fedex runs a tighter ship, though I don't use the franchise drop off locations for any carrier, authorized sorting facilities only for my drop offs. I hope this situation has a favorable outcome. |

I have the luxury of being close to Parcel Pro's NYC office...
Everything I ship, I do so under a camera. It is a small office, usually empty of customers, and cameras everywhere. I unpack the watch, hold it up to the camera, snap a photo of the serial number under the camera while doing so (which is obviously timestamped on my phone), then package, drop, and collect my drop off receipt. Also, one thing most people don't realize, but should do, is open the package while the driver is still present right after signing. If the box is empty, there is no disputing it. Regardless, from the sales side of the equation, I feel I cover my bases as well as could be. Hoping for a positive outcome for the OP. ETA: You should not do this in a regular UPS/FedEx location for obvious reasons. |

we think alike. i am a ham radio operator and have many expensive radios. when the cable people come inside, i cover everything as best i can. better safe than sorry. best to say the Rolex is a gift and that you wear beater watches. wear a Patek or something to throw him off.

What a mess ... Very sad...
I have only a few doubts about it, maybe a little stupid: Is the seller still contacting you? He dosen't login on since july 3. Is the serial number on the card the same as it was on the watch? The box and card are the same of the sale topic photos or of some pic that the seller have sent to you during the negociation? I hope all this is resolved in the best way possible. |

Good grief...I’m sure the OP would update us if there had been a resolution.
UPS and the value of an item doesn’t delay an investigation. The facts of the case (as it relates to UPS actions) are usually determined inside of a week. But when there are extenuating circumstances, or if an insurance fraud is suspected, UPS has to involve law enforcement. So the seller may be the cause of a delay if s/he isn’t cooperating or if a criminal case is being built. Sent from my iPhone using Tapatalk Pro
