Not all is personal. Mostly business. Don't let the numbers fool you or read too much into it. 9.25% where I am. In small business, you take the loopholes where you can get them. It is what it is. I follow the rules set forth by the morons in DC.

Google use taxes. You owe the tax in your home state.

Sales tax are set by the states, not in DC.

If you run a business and you do not self assess tax for out of state purchases that is not a loophole it’s tax fraud. This is business 101. This is not a rule in DC this is a rule passed by your state government.

Unless you resell and collect tax in the state in which you reside. No self assessment needed.

Hahahahaha. I haven’t been here that long, but I’ve been here long enough to know that every one of these sales tax threads ends up in the same place.

Spatula, were you asking Mayors to ship to avoid taxes or because you didn't want to carry them around on the road?

Now you are just making things up. If you are a business (or an individual) and you make a purchase from out of state, and you local jurisdiction has a sales tax, you owe sales tax to your local authority. This is black and white. Few random states. All are clear -- out of state purchases are subject to sales tax.

Rules for CA:

https://www.boe.ca.gov/ads/news06.htm

"California law requires tax on in-state purchases, and also requires tax on items purchased out-of-state for use in California."

Rules for GA

https://dor.georgia.gov/what-subject...ed_links-486-0

“Use tax” is also a term commonly used to refer to the tax imposed on taxable goods and services that were not taxed at the point of sale.

Rules for FL

http://floridarevenue.com/Forms_libr...t/gt300015.pdf

"Use tax is due when taxable goods or services are purchased, tax is not paid at the time of purchase, and the taxable goods or services are used or
consumed by the buyer"

Any authority you can cite for your proposition.

Anyway, all it takes is one state audit and your "business" is up in smoke. But you do you.

I agreed over the phone that I would come in tomorrow to purchase the watch. However, I later asked if the watch could be shipped out of state and got an immediate no.

Is it no longer allowed for AD's to send watches out of state, even when the purchase was done in store?
Or is this associate telling me no because he think's he's doing me a favor by selling me this watch? (which I guess you can argue that he is doing me a favor)
Ad this past weekend would not ship to me either. Only blnr I had found so I paid tax. Was only 5%.

Similar thing happened to me. I spoke with an AD sales manager in Colorado about their newly arrived SD43. I offered to pay for it and have it shipped. Doug, I think his name was, said he wouldn't do it because he didn't know me and didn't want to see it posted for sale here for a profit. He said he wanted to meet me personally. I told him I'd be willing to fly there to meet and pick it up. He never called me back.

For what it's worth, the watch is a BLNR. Not crazy but not exactly easy to find either... I've only ever seen it at an AD in Taiwan that wanted a $600USD markup.
Yeah.. they are crazy like that. A dealer who my family had bought a few watches from put me down on the list for C Daytona. Called me 9 months later saying the watch is in. Just as I was ready to pay over the phone, they told me they are selling it at NT490,000 (which is $16,350). $4000 over MSRP! I politely declined it.

BLNR, it is a hot model that may not always be sitting in the dealer case, but you definitely can get one if you wait a few months. I say, go visit a few different dealers and tell them you want one and are willing to put a deposit down. I think if a dealer has it in stock, they are less willing to do negotiate because they know they can sell the watch in days. If they don't have the watch yet, I think they are more willing to work it out with you

Hey OP,
Just buy the watch on TRF, have it shipped and avoid the tax.
End of story

Yup. But this isn't the first time I have heard of an AD not willing to ship out of state. Absurd but is what it is.

Prob just bc you were over the phone. I'd go see them in person, bring cash, and you should be able to get it done.

In my experience policies differ. Not only among AD's but within the same AD! They told me that they wouldn't ship out of state, yet when I was last there I heard them arranging a shipment to another state. I honestly think it has a lot to do with your annual purchases and also how well the owner knows and likes you. Really.

Most likely a store policy, not AD. I would just make a trip out of it.
