I agree - but the problem is, sometimes big companies will look for slander/libel and can sue for a large sum of money, much more than I have. Still - if they play hardball, I will too, I am not going away, believe me.

When I found out the recepient of my watch was a lawyer for FBI, I sent the package USPS Registered.

I had a smilar experience a few years ago. I had a Rolex mailed via FedEx, got the box, opened it up, and it was empty. After a couple visits with the lawyer, numerous calls, letters, etc, all I ever got was around $1k. I could have filed a lawsuit, but in the end, the time, money, and frustration of it all would have resulted in a net loss. Best of luck however, hope you get them for the both of us.

Sorry to read of the loss.

UPS requires a declaration of the contents when claimed over $1000 because it is at their discretion if they will take the shipping risk. If you tell them it's $5000 and pay for the insurance over and above the $100 that is standard you are protected.

Since you guys have asked :chuckle:

This is the case of shoulda-woulda-coulda... I should have read the smallprint, FedEx should have delivered my friggin watch.... Neither happened, and naturally, their 'settlement' offer was ridiculous and unacceptable. Since, I have brought this to the attention of my attorneys, they have communicated with FedEx Legal Dept directly and we have reached a settlement agreeable to both parties. Naturally, it was not exactly where I would have liked to be, but is a good compromise. Furthermore, my attorneys have been gracious enough no not charge me any fees for this, so I netted a satisfactory amount.

I still don't intend to use FedEx in the future without 3rd party insurance, but at least I sleep somewhat well at night.

And to the thief who is wearing my GMT - keep it, you need it more than I do, you sad SOB. Eventually it will get around to you, karma DOES exist.

Agree with the Karma Greg and the third party insurance...!

Remeber the serial number will pop up as being a theft when it is checked out as a service, pawn. etc. :thumbsup:

Register the serial number with Rolex and maybe 20 years later it will show up for service and get returned to you.

Hey Mosco, a loss is still a loss and this sh*t should not happened to great sellers here on TRF especially coming from a big corporation like Fedex. :comeandge

Will update my peers over here in Asia to be careful on all deliveries.

Do log your loss with Rolex and you never know it will turn up in Singapore (one of top trading hub for horological pieces)

I'm sorry you had to go thru such a frustrating, stupid ordeal. I'm glad you stuck with it and are pleased with the negotiated settlement and that FedEx was held somewhat responsible for your loss.

Whoa! I cannot believe that. I have a close relative that has worked for UPS for many years now, and believe me... heads would roll if anything like that happenned there. If I were you I'd pay another visit to that FedEx/Kinko's just to see if that same guy is still working behind the counter. Man, my hat's off to you Greg for having such phenominal composure. I would have spun a bearing. Pulled a Chevy Chase from National Lampoon's Vacation... "the moose says you're closed, I say you're open". Well, on a more serious note I'm glad to hear that you were able to reach a fair settlement. Hope you get the watch back too! :comeandge

i would def go back to the fedex/kinko a few weeks from now and ask around other employees regarding the employee that did your transaction. Did he mention anything about or showing off a new rolex?? if so, not only can you go after fedex, but also kinkos as well.

but yes Karma works in mysterious ways!!!
