It's been 9 months so I agree with you - he may never make restitution. The criminal case that is dragging on doesn't stop you from filing a lawsuit, though.
This way if he ever gets any money in the future you might get your money back.

Now much of his business is done over the phone as those clients order engagement rings, watches and bracelets from their desks in midtown. "Customers who started as watch-battery clients are now buying bracelets for $5,000 from me," he says. "I've maintained these customers for that long." A Web site is also in the works. More people now shop for jewelry online, says Mr. Rafeld, who wants to make it easier for those who can't get to his shop. "These people who work on Park Avenue are talking each day with people all over the world," he says. "They have referred me to their colleagues and friends in London, France and Brazil." When Tiffany & Co. opens a location down the street next year, Mr. Rafeld will work on Saturdays. "I'm no competition to Tiffany's, but they will increase the foot traffic," he says. "And if I can attract at least one new customer of that caliber, then it's worth it." |

File a Police report and take that to your closest AD so it can be entered into the Rolex database. If it ever comes in for service, they will confiscate it and contact the police.

It is a sad story of his slide from being a self-sustaining retailer has hurt so many innocent people.
Some take adversity (like the WTC 9|11 impact to his business) and survive with their scruples intact. But others turn on their fellow citizens to further victimize them. In this case, he slid into crime to make ends meet and now will pay the consequences. Thanks for the update OP. Wow crazy story. Thats awful. You might be able to find him though. As he had his business registered and you know who it is. Its harder to find someone who mugged you with a mask on than go to a shady business and get scammed.
