need some opinions/advise
I just purchased a preik sapphire case back for my sub again. The first time i got one, i installed it, reverted back and sold it.
Now i've got the itch again and bought a new one. HOWEVER, while browsing Preik's website, i noticed that the photo he uses to advertise his caseback is one of my photos i took back in 2013; he is using it without my permission. I was never contacted about its use, and only learned about it now that i've bought a new one. As much as i love his products, and fully support his business, i'm a little irked that i wasn't contacted for permission to use my photo for the purpose of selling his product. Is there anything I can do in this situation? here is my photo that i uploaded to flickr back in 2013 https://www.flickr.com/photos/chanma...-fLbESW-kiSz4M and here is Preik's page selling the case back http://www.customwatchconcepts.com/p...products_id=36 Thanks for any insight you guys can give :) Cheers, Matte |

A forum member is using one of my pix as his avatar.
No harm done and I'm taking is as a compliment. You could just do the same after all you a pix of his caseback on the Web.

if only it was something as simple as an avatar.
i am flattered that he found it nice enough to use but, at the end of the day, he's using my photo to make money. least he could do is give credit where credit is due. maybe i'm just over reacting, or over thinking it, but maybe i'm also justified in feeling a little annoyed that i wasn't at least asked. |

Life's pretty short. And while I understand your point, not sure getting aggravated about a photo you didn't care about till you saw someone else using it, is worth it.

I would ask for a free caseback as a courtesy.

I've been in touch with him and he's a simple and very kind and caring guy.
He's far away from being a greedy multi-million company. I doubt that he could even afford one or two of his shown watches. If it really bothers you , send him an email with the pic in question and ask him to remove it. |

If a song/track from a recording artist is, say, used in a movie, the artist is paid royalties, regardless of whether they have enough money to buy a small Caribbean island.
How many times have we heard about people/organisations being sued for copyright? I'm not for one nano second suggesting that the OP should attempt to sue or anything like that. That would be plain silly and not cricket. However, he should contact the seller of the case backs and at least request that a simple "photograph reproduced by kind permission of Mr. XXXX" be embossed in the corner of the subject image.

Wish i could relay that he was kind and caring.. My queries to him fell of deaf ears but i still wouldn't consider any harsh action.
Try to confront the situation of you finding the picture and plans to purchase a new caseback with a little charm and see what happens. Back in the day i put rims that were more commonly styled for porche on my mustang and the pictures circulated to a few sites. I took it as a compliment. |
